Terms of Use

1. Using the Service

FLOG OFF lets you snap a photo of an item, generate a listing with AI-assisted description and price suggestions, publish it to the community marketplace, and message other users to arrange a sale. You may browse and analyse items without an account, but listing items and messaging require sign-in.

2. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements.

3. Your Account

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information and to keep it up to date.

4. Your Listings and Content

• You are solely responsible for the accuracy, legality, and ownership of the items you list and the content you post.
• You may only list items you own or are authorised to sell, and that are legal to sell in your location.
• You grant FLOG OFF a licence to display, reproduce, and process your listing content (including photos) for the purpose of operating and promoting the Service.
• AI-generated descriptions and prices are suggestions only. You must review them and are responsible for the final listing content and price.

5. Prohibited Conduct

You agree not to:

• List counterfeit, stolen, illegal, or prohibited items.
• Post misleading, fraudulent, or offensive content.
• Harass, threaten, or mislead other users.
• Use the Service for any unlawful or commercial resale business without authorisation.
• Attempt to disrupt, reverse-engineer, or abuse the Service or its AI features.

6. Transactions

FLOG OFF is a free community marketplace. We do not process payments or guarantee transactions. Any exchange of money, goods, or services is arranged directly between you and the other user, and you do so at your own risk. We are not a party to any agreement between users.

7. AI-Generated Content

AI-generated titles, descriptions, categories, conditions, and prices are provided as a convenience and may be inaccurate. FLOG OFF is not responsible for any loss arising from reliance on AI-generated suggestions. You are responsible for verifying all listing details before publishing.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or that listings or users are legitimate. To the maximum extent permitted by law, we exclude liability for indirect or consequential damages.

9. Limitation of Liability

To the extent permitted by law, our total liability arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the past twelve months (which, for a free Service, may be nil).

10. Termination

You may delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we believe your activity poses a risk to the Service or its users.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the app and updating the "Last updated" date. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
